Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BarbaGlow application and related services (the "Service") provided by BarbaSolution d.o.o. ("BarbaSolution", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

2. The Service

BarbaGlow is a software-as-a-service (SaaS) platform that enables salons and service businesses to manage appointments, employees, clients, services, and online bookings. The Service is provided on a subscription basis.

3. Eligibility and Accounts

To use the Service you must be at least 18 years old and able to enter into a binding contract. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate and complete registration information and keep it up to date. Notify us immediately of any unauthorized use of your account.

4. Subscriptions and Billing

The Service is offered under subscription plans. Subscription fees, billing cycles, and plan features are presented at the time of purchase. Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. Payments are processed by Paddle (Paddle.com Market Ltd), which acts as the Merchant of Record for all purchases. Paddle handles billing, payment processing, and applicable taxes. By subscribing, you also agree to Paddle's buyer terms. You are responsible for any applicable taxes not collected by Paddle and for keeping your payment information valid.

5. What You Receive

An active subscription grants you a non-exclusive, non-transferable, revocable right to access and use the Service for your business operations, in accordance with your selected plan and these Terms. We may update, improve, or modify features of the Service over time.

6. Acceptable Use

You agree not to:

• use the Service for any unlawful, fraudulent, or harmful purpose;
• attempt to gain unauthorized access to the Service, other accounts, or our systems;
• interfere with or disrupt the integrity or performance of the Service;
• reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
• resell, sublicense, or otherwise commercially exploit the Service without our written consent;
• upload malicious code or use the Service to transmit spam or unsolicited communications;
• misuse the Service in any way that violates these Terms or applicable law.

7. Your Data and Responsibilities

You retain ownership of the data you enter into the Service, including your clients' data. You are responsible for the accuracy and lawfulness of that data and for having any necessary consents to process your clients' personal data. With respect to end-client personal data, you act as the data controller and BarbaSolution acts as the data processor, as described in our Privacy Policy. You are responsible for maintaining your own backups where appropriate and for ensuring your use of the Service complies with applicable laws, including data protection laws.

8. Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, if: you breach these Terms or engage in abuse, fraud, or unlawful activity; your payment fails or your subscription lapses; required by law or to protect the security and integrity of the Service. Where reasonable, we will provide notice before suspension. You may cancel your subscription at any time; cancellation stops future renewals but does not entitle you to a refund except as described in our Refund Policy or required by law. Upon termination, your right to use the Service ends, and we may delete your data after a reasonable retention period.

9. Intellectual Property

The Service, including its software, design, trademarks, and content (excluding your data), is owned by BarbaSolution and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.

10. Service Availability

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, BarbaSolution shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from or related to your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid for the Service during the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold BarbaSolution harmless from any claims, damages, or expenses arising from your misuse of the Service, your data, or your violation of these Terms or applicable law.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest revision. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of Bosnia and Herzegovina, without regard to conflict-of-law principles. Any disputes shall be subject to the jurisdiction of the competent courts in Sarajevo, Bosnia and Herzegovina, unless mandatory consumer protection law provides otherwise.
